On the morning of June 5, Metro Police Officers responded to a call of shots fired at the Penthouse Gentlemen’s Club. Officers learned that the suspect, later identified as Dominic Nieto was driving a black Hummer H-3 and had fled the scene.

An officer in the area spotted the vehicle at Russell and Rainbow. The officer attempted to stop the vehicle, but the suspect fled into a residential area. During the pursuit Nieto lost control of the vehicle and rolled into a desert area near Durango High School.

As Officer Blake Penny approached the vehicle, Nieto opened the driver’s side door, stood up and fired multiple rounds at him, striking him in the right leg. Penny returned fire at Nieto, hitting him. After firing shots at the officer, Nieto ducked back inside his vehicle and refused to come out. Officer Penny was rescued by other arriving units.

Since Nieto refused come out of his vehicle, the Metro SWAT Unit was called to the scene. SWAT was able to approach the vehicle, where they discovered Nieto deceased inside.

Officer Penny was transported to the hospital, where he underwent successful surgery and is recovering.
