Good morning everyone,

I want to know if anyone can tell me whether it is illegal for a bank to post a default notice on the wrong property? THis happened to us and our neighbor said another lady from the community did not recognize the name on the document so she left it with her (she knows everyone in our small community) ANyhow - we feel it was an invasion of privacy that now everyone knows we are financially in trouble? Can we sue the back for being so careless? Please help!

I have a first mortgage at 6% interest. A second mortgage at 4.25% variable interest. The two mortgages combined are about $262,000.00 but my value has dropped by at least $60,000.00-75,000.00. I just called Chase Mortgage to see if I could get my loan modified into one as both my mortgages are held with Chase Mortgage. They have a message telling you to contact them directly not to go through a third party company to perform a loan modification. I explained to them my situation and how if my second mortgage goes up in interest I could possibly be in the same situation as many who have lost their homes. I am not behind and have good credit. After giving all my information to the representative I was told it would take 30-45 days to be contacted so I asked will this affect my credit and she said no. She then explained she could not work on the second mortgage because that is a separate department and I would have to apply for the same thing a second time on my second mortgage. There was no way to get any help on a combined effort. This made me a little discouraged so I figured I would pry on the way this works. Here is the way she explained which would not ever help it sounds like it would hurt unless you were really in a foreclosure situation:

1- You don't make any payments for three months and at the end of three months then they start the modification process.(This made me push three times because it didn't make sense. She said during the three months they are collecting information. Also I asked about my credit being affected she said it would not. I'll come back to this step)
2-Then after not making the payments you find out what the modification is.(This also made no sense as I expressed so she felt compeled to give the true disclosure which was there is a possibility they could raise my rate! Remember I have a fixed 6% rate so supposedly this is going to help.)

Starting to make sense of the things I was hearing I pushed it back to the representative. "So I am basically going into the foreclosure process without affecting my credit to default on my loan(1st step),"
I said surprised. "To top it all off I could end up with a higher rate on something that should help me which would definately not help if you raised my first mortgage that is fixed at a descent rate(2nd step), I said upset.

Now remember I have to do this separately on each loan. I know they are preying on people already in fear of their situation. If I wouldn't have pushed I would have thought like most people oh great no payment for three months not realizing they really want to push me into a bad situation. I thought the point of modifying the loans was to help people not push them into bad situations. They really would most likely push me into foreclosure if they raised my rate. Channel 8 I hope you can investigate this and let the public know that they could be hurt worst than they might already be in. Here are some #s 702-259-7171 then transfered to call 1-800-848-9380 then transfered to 1-866-550-5705 also told to call 1-866-613-2350.

I lost all hope for the current administration to actually help the people who have fallen victim to their own greed and selfserving interests. When Obama came out of the gate paying off political favors with huge unprecedented perks and payoffs I could see the way the winds were blowing. The innocent who are caught in this are those like me who put huge down payments on their American dream. My job is now in the sites of the administration their backhanded ploy to help people get and keep health insurance will actually leave more uninsured than ever before. I do not believe that is an accident. They need more uninsured to foster a need for the "Government assistance" they want to offer to enslave more Americans. So back to the subject...if I lose my job I caqn hang on for a few months to maybe a year then I will lose my house in which I have invested a significant amount of my money. So I will have destroyed my credit lose my job and home and will be a newly acquired drone of the new USSA. The reins of control are being handed to a bunch of socialist losers who are more than happy to punish us for following our founding fathers (and mothers) on a path to success. If you are a citizen of this country and you are not upset you are the problem. Fix yourself and the country will follow

Well, were still waiting for Whileshire and Wells Fargo Bank to decide if they will help us keep our home! We've tried everything possible! We made our house payments from April 2005 until the Crash coming in August of 2007. We started calling LIME FINANCE, then WHILESHIRE the servicers and we've tried working directly with WELLS FARGO BANK. We've lost our savings and our Investments for retirement. Our home is all we have left. It's now only worth about $400,000.00 to $450,000.00 if we're lucky. We have patio homes behind our house and an Apartment Complex that is going up behind us as well, so I expect our home to drop again in value here in Las Vegas. There are homes at "THE FALLS" at LAKE LAS VEGAS, that have set on the market now for over 2 years and their values have plummeted from a $650,000.00 value in 2007 to $265,000.00 on the Golf Course. That's how bad we've been hit and we were Real Estate Agents. We look everyday to see what is happening in Las Vegas. We need help from our Government! It's time to help the Homeowners that have and are losing everything through no fault of their own in many cases. It's not right.

I would like to thank MGM for it's falsed promises and denying raises to it's employees while one of the CEO's of Mandalay Bay buys a new exotic car, what a slap in the face. Needles to say That the Security Officer are slowing loosing there jobs to Part-time officer who work more than 32hours a week and not getting health benefits...the list goes on, don't trust MGM, they are not for the community......Should have George Knap investigate the partime security officers who get special treatment.

Here is my only problem with all of this. I was here before the boom, I saw it coming. Sorry but if I can double my money in 13 months, there is a problem. Walk away with cash in the same amnt. my house was when I bought it. I remember fights breaking out, people sleeping in their cars for phase releases...prices going up 25K per phase, did everyone think that this was NOT going to happen? These interest only loans, ARM loans, HELLO PEOPLE, you knew what you note was going to be, the day you signed papers closing title???? Why be mad now that your house is worth NOTHING, but you bought it anyways at its HIGHEST??? I have no sympathy for some people. Walking into a home now, people even are taking toilets???? the TOILETS!!!! ARE YOU SERIOUS??? Last time I checked it was not the banks fault that you got suckered, it is your own. Period. Destroying that home is adding to not only your ignorance, but also the economic crisis. Here I am RENTING a home that I paid my rent on, but the landlord decided not to pay the mortgage??? 5 kids, and a notice on the door???? SORRY but if I for one second would do anything to destroy something that WAS NOT MINE TO BEING WITH...jsut like you, I paid everymonth, HOWEVER did not hold the TITLE/DEED to it. Realistically does anyone stay in a home for 30 years anyways???? Cummon now, get real. Being angry cause you came in at the end, you should have done research, there has never been a increase like Vegas had between 2002-2004...NEVER!!! Dont be upset because you were not intelligent enough to look on the assessors page and see how quickly it went up, either that, or thought that you were going to cash out like those of us who did..you got in too late...period. I took my money and ran...renting now...about to buy again. Check the DMV to see how many people moved here and changed their licenses over DAILY back in 2003..this was BOUND to happen. PERIOD.

My husband has spent a year trying to get WELLS FARGO BANK to modify our home loan. He's called Lime Financial, Whileshire Mortgage and Wells Fargo since we found out they purchased our note. Each time since August of 2007,we've been told lies, and promises that never happened. We would call 3 to 4 times a WEEK, trying to get a loan modification because our home is under water by 50% and so has our income. If Wells Fargo Bank would do this for us then we would no longer be a statistic. We would be able to keep our home and pay our mortgage. We thought that Wells Fargo Bank was suppose to call us to work out our home loan but all we got was an Attorney with Wells Fargo Bank saying they were going to Foreclose on us. We tried to explain to him what we were and had been trying to do but he didn't care. We have to go to court March 26, 2009 in hopes of keeping our home. All we wanted from Wells Fargo was a little help to keep our family home.
